NexAble is a trading name of NexSafe Ltd ('NexAble', 'we', 'our' or 'us'). These Terms and Conditions apply to all purchases made through our online shop. By placing an order, you agree to be bound by these Terms. Nothing in these Terms affects your statutory rights under applicable UK consumer law.

2. Eligibility
You confirm you are legally able to enter into a contract and that the information you provide is accurate.
3. Orders
Submitting an order is an offer to purchase. A contract is formed only when we accept your order. We may refuse or cancel an order before dispatch for stock shortages, pricing errors, suspected fraud or any other legitimate business reason. If payment has been taken, it will be refunded.
4. Product Descriptions
We aim to ensure descriptions and photographs are accurate. Images are illustrative only. Colours, dimensions and appearance may vary slightly depending on screens and manufacturing tolerances.
5. 3D Printed Products
Many products are manufactured using additive manufacturing (3D printing). Visible layer lines, small cosmetic imperfections, slight colour variation, texture differences and minor dimensional tolerances are normal characteristics of the manufacturing process and are not defects. We reserve the right to improve designs, materials, colours and manufacturing methods provided the intended function is not materially affected.
6. Made-to-Order Products
Some products are manufactured after an order is placed or made to your chosen specification. Manufacture may begin immediately. Personalised, bespoke and made-to-order products cannot normally be cancelled or returned for a change of mind once production has started, unless required by law or the goods are faulty.
7. Medical Products and Accessories
Unless expressly stated otherwise, our products are accessories intended to be used alongside medical equipment. They are not medical devices, are not intended to diagnose, treat, cure or prevent any medical condition and must not replace professional medical advice or the manufacturer's instructions for your equipment.
8. Product Suitability
Advice provided by NexAble is based solely on the information you provide and is general guidance only. You remain responsible for ensuring any product is suitable for your intended use and compatible with your equipment. Where appropriate, seek advice from your clinician, occupational therapist or other healthcare professional before purchase.
9. Safe Use
Products must only be used for their intended purpose. Inspect products before each use and discontinue use if damaged, excessively worn or modified. Children and vulnerable persons should be supervised where appropriate.
10. Compatibility
Where products are designed for use with specific equipment, compatibility information is provided in good faith but cannot be guaranteed for every version, accessory or third-party product.
11. Pricing and Payment
All prices are in Pounds Sterling. VAT will be shown where applicable. Prices may change before an order is accepted. Payment must be received before dispatch.
12. Intellectual Property
All product designs, CAD files, STL files, drawings, branding, logos, photographs, website content and other intellectual property remain the property of NexSafe Ltd unless otherwise stated. They may not be copied, reproduced, reverse engineered or commercially exploited without written permission.
13. Limitation of Liability
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence or fraud. Subject to this, we are not liable for indirect or consequential losses, loss of profits, business interruption, misuse of products, modifications made after purchase, use outside the intended purpose or failure to follow instructions. Where permitted by law, our total liability relating to any product shall not exceed the purchase price paid for that product.
14. Product Safety
Customers are responsible for regularly inspecting products and ensuring they remain safe to use. Damaged or unsafe products should be withdrawn from use immediately.
15. Refusal of Future Business
We reserve the right to refuse future orders or cease dealing with customers who behave abusively, threaten staff, commit fraud, abuse chargeback procedures, make persistently unreasonable or vexatious demands, or where continuing the relationship would create an unreasonable operational or commercial burden. This does not affect statutory rights relating to orders already accepted.
16. Third-Party Products
Third-party trademarks remain the property of their respective owners. Manufacturer warranties apply where offered by the manufacturer.
17. Privacy
Personal information, including medical information voluntarily supplied to help determine product suitability or VAT relief eligibility, is processed in accordance with our Privacy Policy and UK data protection law.
18. Other Policies
Our Shipping Policy, Returns & Refunds Policy, Warranty Policy, Privacy Policy and VAT Relief Policy are separate documents and form part of your purchase where applicable.
19. Changes
We may update these Terms from time to time. The version published at the time of your order applies to that purchase.
20. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
